LUBBOCK, TX - Investigators with the Department of Public Safety say a tow truck driver, involved in a deadly accident along the Slaton Highway earlier this month, did not have his commercial driver's license.
They also report that the teen killed in the crash, 19-year-old Michael Ybarra, did not have his head lights on at the time of the crash.
Ybarra died on August 8th, when he collided with the tow truck as it made a u-turn on the Slaton Highway and FM 1585. Ybarra's SUV burst into flames. A witness says he asked the tow truck driver for his fire extinguisher, but they could not find one.
DPS troopers say commercial vehicles are required to have a fire extinguisher in case of an emergency. According to the official report, the tow truck driver is now charged with not having a CDL.
